-Must submit your video by Sunday, October 27th

The following are the rules governing the Burrito Lift contest conducted by Pancheros Franchise Corporation.

Prize(s). A total of four prizes will be awarded consisting of 1 standard burrito per week for 52 weeks, not including extra filings, toppings, queso, guacamole, etc. Pancheros may provide winners with physical or electronic coupons or promo codes to be redeemed at participating Pancheros’ restaurants. The prize is not transferable, redeemable for cash or exchangeable for any other prize. Participants must provide valid and accurate contact information. If a winner cannot be contacted or is disqualified for any reason, Pancheros reserves the right to determine an alternate winner or not to award that winner’s prize, in its sole discretion.

Entries.

Entries are made by a natural person posting a video to a personal Instagram + TikTok account or posting a video from a personal X account in combination with the hashtag #BurritoLift. Pancheros will monitor both platforms for posts using the #BurritoLift hashtag. Videos should be a minimum of 5 seconds long. Posts may be made between Friday, October 11th and Sunday, October 27th. Winners will be selected by Pancheros in its sole discretion; generally Pancheros is looking for the best Burrito Lift. Eligibility and Limitations. Participants and winners must be natural persons who are U.S. residents. Limit of one entry per person; multiple entries or duplicate posts or tweets may results in disqualification. Use of multiple accounts on one platform by one person to submit multiple entries is specifically prohibited; cross-posting between a person’s Instagram account, TikTok account, and X account shall be considered one entry, provided the same handle is used on both accounts. Entries including inappropriate or irrelevant hashtags will be disqualified. Entries by bots or on behalf of companies or businesses are prohibited. Only one prize per household for the contest. There is no limitation on age, however, a parent or guardian will be required to sign a release on behalf of the minor to be eligible to receive a prize, but Pancheros reserves the right to refuse to award a prize to any minor. Employees of Pancheros, the contest’s participating sponsors and their advertising agencies, and members of the immediate family or household of any such persons are not eligible to participate or win.

Tax. Any valuation of the prize(s) stated above is based on available information provided to Pancheros, and the value of any prize awarded to a winner may be reported for tax purposes as required by law. Each winner is solely responsible for reporting and paying any and all applicable taxes related to the prize(s) and paying any expenses associated with any prize which is not specifically provided for in the official rules. Each winner must provide Pancheros with valid identification and a valid taxpayer identification number or social security number before any prize will
be awarded. Any person winning over $600 in prizes from Pancheros will receive an IRS form 1099 at the end of the calendar year and a copy of such form will be filed with the IRS.

Publicity; Use of Personal Information. By participating, where allowed by law, all participants and winner(s) grant Pancheros an exclusive perpetual permission to use their videos (with or without audio), audio separate from the video, and their names in connection with promotion of Pancheros restaurants and waive any claims to royalty, right, or remuneration for such use. By participating in the contest, where allowed by law, participants agree that Pancheros may disclose personal information obtained from participants in the contest to third parties and use such information for marketing and other purposes. In order to receive a prize, a winner (or their parent or legal guardian) shall be required to sign a release.

Disqualification. Pancheros reserves the right to disqualify any entry not conforming to the rules of the contest at any time. Persons who attempt to gain an unfair advantage in participating in the contest, or obtain winner status using fraudulent means will be disqualified. Unsportsmanlike, disruptive, annoying, harassing, pornographic, or threatening content in an entry will result in
disqualification. Violation of Instagram’s, TikTok’s, or X’s terms of service may result in disqualification. In the event Pancheros determines that an ineligible entrant has won a prize, Pancheros reserves all rights to the ownership and return of the prize and all costs associated with remedying any prize award to an ineligible entry or entrant.

Misinformation. Pancheros is not responsible for undeliverable, lost, delayed, misdirected or misaddressed communication or any other issues regarding the electronic delivery of the contest entry.

Release. By participating in the contest, each participant and winner waives any and all claims of liability against Pancheros, Instagram, TikTok or X, their employees and agents, the contest’s sponsors and their respective employees and agents, for any personal injury or loss which may occur from the conduct of, or participation in, the contest, or from the use of any prize. Each participant and winner acknowledges that Instagram, TikTok, and X in no way sponsor, endorse or administer the contest, or are associated with the contest.

Conduct and Decisions. By participating in the contest, participants agree to be bound by the decisions of Pancheros personnel. Pancheros will interpret these rules and resolve any disputes, conflicting claims or ambiguities concerning the rules or the contest and Pancheros’ decisions concerning such disputes shall be final. If the conduct or outcome of the contest is affected by human error, any mechanical malfunctions or failures of any kind, intentional interference or any event beyond the control of Pancheros, Pancheros reserves the right to terminate this contest, or make such other decisions regarding the outcome as Pancheros deems appropriate. All decisions will be made by Pancheros and are final. Pancheros may waive any of these rules in its sole discretion.

Miscellaneous. Void where prohibited. Pancheros may substitute prizes, amend the rules or discontinue the contest at any time as announced. Pancheros disclaims any
responsibility to notify participants of any aspect related to the conduct of the contest.

Compliance with Law. The conduct of the contest is governed by the applicable laws of the State of Iowa, which take precedence over any rule to the contrary herein. Pancheros shall follow the applicable laws for conducting contests, as required by local and state law.
